Terms and Conditions of Sale
1. Preamble
These General Terms and Conditions of Sale (GTC) govern sales made on the Popmee website, operated by the seller identified in the site's legal notice. Any order placed on the site implies full and unreserved acceptance of these GTC.
2. Products
Popmee offers personalized miniature figurines, made to order from a photo provided by the customer. Each figurine is created based on the digital preview generated from the photo provided by the customer before order confirmation.
3. Prices
Prices are indicated in euros, all taxes included (TTC). Popmee reserves the right to change its prices at any time; products are invoiced based on the rates in effect at the time the order is confirmed.
4. Ordering and Personalization
The customer must provide a photo they have the right to use (a personal photo or one for which they hold the rights). The customer guarantees that the submitted content does not infringe upon the rights of third parties or public order. A digital preview is generated directly from the photo provided by the customer via the tool available on the site before the order is confirmed. The customer can view this preview before confirming and paying for their order. Once the order is validated, production may begin without further previews or subsequent approval.
5. Payment
Payment is due in full at the time of ordering. Popmee uses secure payment methods provided by Shopify Payments and/or other authorized payment providers.
6. Delivery
Manufacturing and delivery times are indicated on the product page for reference only. Popmee cannot be held responsible for delays attributable to the carrier.
7. Right of Withdrawal
In accordance with Article L221-28 13° of the French Consumer Code, the right of withdrawal does not apply to goods manufactured according to consumer specifications or clearly personalized. Popmee personalized figurines, created from a photo and specific choices made by the customer, are therefore not eligible for the right of withdrawal, except in the case of non-conformity or hidden defects.
8. Liability
Popmee makes every effort to ensure the highest possible manufacturing quality. Popmee shall not be held liable in the event of misuse of the product or damages resulting from use not in accordance with its intended purpose.
9. Intellectual Property
The customer retains the rights to the photo they submit. By placing an order, they authorize Popmee to use this photo solely for the purpose of manufacturing their figurine.
10. Personal Data
Personal data collected (including submitted photos) is used exclusively for order processing, in accordance with our privacy policy.
11. Applicable Law and Disputes
These GTC are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing an agreement, the French courts shall have exclusive jurisdiction.
