1. Preamble
These general terms and conditions of sale (T&Cs) govern sales made on the Popmee website, operated by the seller identified in the website's legal notices. Any order placed on the website implies unreserved acceptance of these T&Cs.
2. Products
Popmee offers personalized miniature figurines, custom-made from a photo provided by the customer. Each figurine is unique and produced after the customer approves a digital preview.
3. Price
Prices are indicated in euros, all taxes included (TTC). Popmee reserves the right to modify its prices at any time, with products being invoiced based on the rate in effect at the time the order is confirmed.
4. Order and personalization
The customer must provide a photo they have the right to use (personal photo or one for which they hold the rights). The customer guarantees that the content submitted does not infringe on the rights of third parties or public order. A digital preview is sent before final production; the order is only put into production after the customer validates this preview.
5. Payment
Payment is due in full at the time of order. Popmee uses secure payment methods offered by Shopify Payments and/or other approved payment providers.
6. Delivery
Manufacturing and delivery times are indicated on the product page as an estimate. Popmee cannot be held responsible for delays attributable to the carrier.
7. Right of withdrawal
In accordance with article L221-28 13° of the Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized. Popmee's personalized figurines, made from a photo and specific customer choices, therefore do not benefit from the right of withdrawal, except in cases of non-conformity or hidden defects.
8. Liability
Popmee makes every effort to ensure the highest possible manufacturing quality. Popmee's liability cannot be engaged in the event of improper use of the product or damage resulting from use inconsistent with its intended purpose.
9. Intellectual property
The customer retains the rights to the photo they transmit. By placing an order, they authorize Popmee to use this photo solely for the purpose of manufacturing their figurine.
10. Personal data
Personal data collected (including transmitted photos) is used exclusively for order processing, in accordance with our privacy policy.
11. Applicable law and disputes
These T&Cs are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing agreement, French courts will have exclusive jurisdiction.
